Man guilty of bringing A'bad appeals to HC for freedom

Lalsingh Mansingh, who is undergoing life sentence in a case related to the recovery of arms and ammunition from the city in 1992, has approached the Gujarat high court for release from prison as he has already served over 15 years in jail.

The move comes after the state government turned down a similar request of his. Lalsingh, who at present is lodged in the Nabhaa jail in Patiala, Punjab, has moved a petition before the Gujarat high court seeking his premature release.

After primary hearing of the petition, justice HN Devani has asked state government to file a reply and has posted further hearing on August 28.

Earlier Lalsingh had filed two petitions before the Punjab and Haryana high court. The first petition was rejected by the high court as the state government had lodged a protest and the second was withdrawn by him.

Lalsingh submitted before the Gujarat high court that, he has completed 15 years and 19 days in prison as on March 17, 2009.
He further submitted that he had moved several applications for premature release on the basis of his good conduct as mentioned in his history ticket (jail record) in Ahmedabad Central prison and maximum security cell at Nabha jail.

"Lalsingh should be released from jail as he has already spend 14 in years in jail and as per the rule and various judgments of the apex court the state government is empowered to release him from jail," said Dilip Ahuja, counsel of Lalsingh. In 1992, the city crime branch had recovered huge cache of arms and ammunitions like AK47, bullets and RDX from apartments in Juhapura and Narayannagar.

The arm cache was brought to the city to carry out terrorist activities in the state at the behest of Lalsingh and other accused who were members of a group formed in the mid 90s to demand a separate Khalistan. Lalsingh was caught by the Mumbai police on July 25 1992.

The crime branch recovered the arm cache after Lalsingh revealed its whereabouts to the Mumbai police.  Later on Lalsingh and 21 other accused were arrested by crime branch under Tada.  On January, 1997, the designated Tada judge sentenced Lalsingh and some others to  life imprisonment. Meanwhile, 16 other accused were acquitted.

Lalsingh's sentence was subsequently upheld by the Gujarat high court  and the Supreme Court.
