Man fights through rape case, acquitted

Truth prevails! Not many would like to vouch for it, but 38-year-old pan-shop owner Krishna Upadhyay would remember it for the rest of his life.

He was accused of committing rape, all evidences pointed against him and efforts were made to frame him. But Upadhyay fought through the case to prove his innocence, and finally the Surat sessions court acquitted him of all charges.

According to information, Krishna Upadhyay, a resident of Althan Tenement, Bhatar, was accused of raping his 19-year-old maid Meena Rathod, a resident of Talav falia, Bhatar. A police complaint was lodged against Upadhyay and his wife Rita on July 14, 2006.

Interestingly, victim Meena gave birth to a child at new civil hospital the same day.

Upadhyay, who was accused of committing rape on the maid and impregnating her, was arrested by Umra police and booked for the offence. To create a strong case, the police also recorded statements of the victim, her parents and relatives (all which were fake), besides collecting other evidence, as part of investigations. This included false certificates issued by doctors of new civil hospital (DNA has the copies of those).

After a long-drawn court case, Upadhyay was acquitted by Surat district & sessions court on November 17. He was acquitted of both charges of rape and atrocity by the court.

In the judgment, the court said: "After analyzing the proofs, it leads to believe that case lodged by complainant is suspicious. The circumstances and circumstantial evidence shown in the case cannot be believed. Just from DNA reports, it can't be assumed that accused raped the girl and impregnated her. Looking at the evidences, complainant failed to establish the case against the accused and so it is ordered to set Krishna Upadhyay and Rita Upadhyay free."

Upadhyay seemed satisfied with the judgment given by the court and is planning for legal action against those who framed him.

"The mastermind of this game is Sher Bahadur Bhandari, who is my neighbour. We don't have good relations for a long time. Meena's mother Savita used to work at his house as maid. To take revenge of our tussle, Bhandari framed me in the case by taking the help of Meena's family members. They also demanded Rs4 lakh from me, after filing the case. Now Bhandari is absconding, while Meena's parents are now begging for forgiveness," Upadhyay said.

His advocate JM Jadhav said: "Upadhyay helped himself. He collected many documents to show that proofs kept in the case were false. He found out that there were two Meena Rathods - one aged 19 and another 25. While the 25-year-old Meena gave birth to the child, the doctor showed her as 19-year-old Meena to project her as Upadhyay's maid 19-year-old Meena. Other important proofs like blood group of baby, statements of victim's family members and doctors helped him in the case.''
