HC quashes criminal case against IAS officer

Stating that the woman has abused the process of law, the Delhi High Court has come to the rescue of an IAS officer who was dragged in a criminal case by his relative in a matrimonial dispute case and quashed the FIR against him.
 
Quashing the FIR against bureaucrat Vineet Kumar, now posted in Kerala, Justice S Muralidhar said "the complaint is vitiated by mala fides". "The petitioner has been able to establish that the complaint before the magistrate is inherently absurd, improbable and constitutes an abuse of process of law,"
Justice Muralidhar said.
 
According to Kumar's petition, Vandana, the wife of his brother-in-law, had lodged a case agaist her husband, parents-in-law and other family members for harassing her soon after her marriage in 2002.
 
In September 2003, she brought a woman SHO to his official residence to raid his house and after getting no material to establish a case against him, she started finghting with him. Following a verbal arguement with Kumar, Vandana had lodged another complaint before the Magistrate against him for physical assault at his house.
 
The magistrate had summoned the officer to appear in the court in connection with the fresh complaint. Being agrieved with the complaint and summoning order of magistrate, he had moved the Delhi High Court.
