HC dismisses plea of Simi seeking desealing of its property in Delhi

The Delhi high court has dismissed the plea of the banned Students Islamic Movement of India (Simi) seeking to get its premises desealed in the national capital.

Justice S Muralidhar refused to give the direction to the government to deseal the premises located in a South Delhi locality.

In an affidavit filed before the court in response to the notice on Simi's plea, director, ministry of home affairs, had stated that municipal records showed the house belonged to one Habibullah Siddiqui and so neither Simi nor its President Shahid Badar Falahi had any claim on the building.

The court had also directed Simi to disclose the details of its possession of the house.

Following the Central government ban on the organisation in 2001 for alleged involvement in terrorist activities, Simi president Falahi was arrested under the Unlawful Activities Prevention Act and since then the office has been locked.

However, a Delhi high court tribunal lifted the ban on the organisation in August 2008 but it was stayed by the Supreme Court.

Simi, in its plea, had said, "The house is in an utter state of neglect with no guard to restrict unauthorised admission and prevent trespassing."

The petition also said "neighbours have informed Simi members that several thefts have taken place and, in fact, the door is lying ajar and there is no doubt that all articles in the premises have been stolen by now".
