Govt awaits high court nod on Narendra Modi’s golden jubilee dream

Chief minister Narendra Modi has set a key golden jubilee goal. It is to bring down to zero the huge - around 22 lakh - pending court cases in the state by May 2011. For this, it has also allocated around Rs825 crore in the current budget to start around 840 new ad hoc and permanent courts. But the state may miss the dream of achieving this goal as time is running out and Gujarat high court is yet to give the  go-ahead for the creation of new courts.

Highly placed sources said, "Government is worried because time is running out. CM and the government are very ambitious to bring down the court case pendency to zero in the golden jubilee year and also maintain the status by creating such a system in which each case get disposed of within a year. The state government has already taken in-principle approval of the plan of around 840 new ad hoc and permanent courts and around 30 courts which were approved last year. Government has also made budgetary allocation of around Rs825 crore and has also completed all the procedure to take permission of the high court for allocating the fund. However, the high court has not cleared the administrative approval for the creation of court infrastructure and appointment of the ad hoc and permanent judges. Government has also sent reasonable reminders as it is a very time-bound goal.  We hope to get the clearance from the high court at the earliest.''

Sources in the high court declined to comment on the issue.
Every year around 12.76 lakh cases are registered in the state; against that around 13.25 lakh cases are being disposed of. Thus, every year the gap of pending cases is decreasing by 1,00,000. Thus government has to dispose of at least 10 lakh cases out of a total of 22 lakh cases in one go.

The government aims to dispose of two lakh other petty cases by May 2010. It aims to start around 800 new ad hoc courts with same number of ad hoc judges to clear the pending cases in next one year. After zero pendency by May 2011, the government will need to open up 100 ad hoc courts every year which will cost Rs100 crore per annum. Along with ad hoc judges government also aims to appoint ad hoc APPs (assistant public prosecutors).
