Got complaints against cops? 2 panels for help in Ahmedabad

Citizens can approach state police complaint authority or the concerned district police complaint authority

People who wish to lodge a complaint against a police officer can now complain directly to the State Police Complaint Authority or the concerned District Police Complaint Authority set up by the state government recently.

The State Police Complaint Authority will investigate serious complaints against officers of the rank of Deputy Superintendent of Police (DySP) and above. The District Police Complaint Authority, on the other hand, will entertain complaints against police officers of all other ranks in a district.

“The state government recently formed a District Police Complaint Authority in every district of the state and a State Police Complaint Authority for the whole state,” said Amit Shah, state home minister.

“A notification in this regard has also been issued.’’ The complaint authorities have been set up under the Mumbai Police Act-1951.
The state authority can seek relevant information regarding a complaint from any person. It can also direct anyone to be present before it and seek an affidavit as is done by a civil court. Moreover, the state government can recommend the state authority to reinvestigate any case already investigated by the state police.
The district authority can investigate complaints only against police officers of the rank of inspector in a district. Complaints against officers of the rank of DySP and above will be heard only by the state authority.

The district authority can register complaints regarding police station’s refusal to register FIRs. It can also monitor departmental enquires against police officials of the concerned district.
Strangely, while the state government has formed two important authorities to entertain complaints against the police, it has made the state police and the concerned district police in-charge of their functioning.
