Panch’ witnesses including vendors and auto-rickshaw drivers, who were present at the spot when the Sabarmati express carnage had taken place will have to depose before special judge PR Patel beginning July 1 on a daily basis. Sources close to the development said that following charges framed by the special court in the incident against the accused, the four ‘panch’ witnesses will be called before the court to depose before the court every day, the source said.

Charges have already been framed against 100 accused in the case and the six dates for recording evidences have also been fixed on July 1, 2, 5, 6, 7 and 8. The accused have been booked under various charges of IPC including murder, attempt to murder, criminal conspiracy, unlawful assembly provisions of the explosives substances act and the railway act.

The primary accused in the carnage includes Maulvi Hussain Ibrahim Umarji, Mohammed Kalota and Haji Bilal. According to sources, framing of charges is as good as beginning of trials in the case. A source close to the Special investigation team (SIT) said, “All the witnesses against whom summons have been issued will depose before the court. The case will be disposed of as soon as possible.” 

SIT has already submitted a status report of its investigation in the case. Statements of more than 80 witnesses have been annexed with the status report. The SIT had earlier invoked Pota upon the accused of the Sabarmati train carnage. However, in a recent order, the Supreme Court has upheld the Central Pota review committee’s (CPRC) opinion that revoked Pota from the all accused in the case. Now, the case will be tried under Indian Penal Code (IPC).
