Furnish rehab plan for riot victims, high court tells state govt

A division bench of the Gujarat high court headed  by chief justice SJ Mukhopadhaya has directed the state government to furnish the plan for the rehabilitation of riot victims, whose houses at the Chandola lake had been razed by the Ahmedabad Municipal Corporation in November. The bench also pulled up the civic body for razing the houses without following the proper procedure.

It also criticised the civic body of going ahead with the demolition without any alterative arrangements for the riot victims.  The AMC has to furnish the scheme for the rehabilitation on Monday.

An issue of 'victimisation of riot victims' came before the high court as the local civic authority had razed the houses built for the 2002 riot victims at the Chandola lake. The houses were built by an NGOs under their rehabilitation and relief project for the riot victims.

Gagan Shetty, member of special monitoring group appointed by the National Human rights commission, had moved an application before the high court raising this issue.

Amit Panchal and Shivani Rajpurohit, counsels for Shetty, submitted that on November 3, without any prior notice, the AMC along with the local police began demolishing the houses of riot affected muslims. Some 329 dwellings including 172 houses of Siyasat Nagar Colony, where the riot victims were rehabilitated by an NGO, were demolished.

The counsels further said that a madrassa and a school at Chandola lake where more than 1800 people had taken shelter were also demolished.  The entire colony was razed and it was done to further victimise the riot victims, the counsels said.

"The state government failed to disburse the compensation given by the centre to the riot victims for the properties that were damaged during the 2002 riots. It then went ahead and destroyed the shelter created for them by an NGO, which constructed the structure without financial assistance from the authorities," the counsels said.
