Explanation sought from Tihar authorities about attack on Indian Mujahideen man

A Delhi court today sought explanation from Tihar jail authorities as why action will not be taken against them for failing to ensure security of a suspected Indian Mujahideen terrorist who has been assaulted by blade-wielding assailants inside the high-risk cell.

Additional sessions judge Santosh Snehi Mann directed the jail authorities to submit an action report on the recent attack on Salman, an accused in the serial blasts cases in the capital in 2008.

"It is necessary to call for action taken report and to call for an explanation from authorities as to why necessary action be not recommended against them for failing to discharge their duty and statutory obligation under the Criminal Procedure Code," the court said.

ASJ Mann also took exception to the submission by the jail authorities that the victim of the attack had told the police officer, investigating the matter, that he did not want to pursue the case or seek any action against his assailants.

"Very surprisingly, the report submitted by jail authorities concludes and observes that Salman had given a written statement before the investigating officer that he does not want any action against Deepak and Sundar (his assailants)," the court noted.

"Now, the action in cognisable offences will be initiated after taking the opinion of victim," the court told public prosecutor Rajeev Mohan.

The court was hearing an application filed by Salman's counsel Khalil A Ansari and Iftikhar Ahmad seeking action against jail authorities for failing to protect the undertrial who was given blade wounds on August 27 at his high-risk cell.

In a report submitted in the court, the jail authorities claimed that they had already informed the SHO Hari Nagar about the incident, besides intimating the jail inspecting judge about it.

They also informed the court that Salman had already been shifted to jail number eight from jail number five.

They also submitted in the court a compact disc containing the video footage of CCTV camera which recorded the incident.

Salman is facing charges in connection with five cases registered following the serial blasts in the national capital on September 13, 2008.

He remained untraceable after his name surfaced in the cases of the serial blasts before being arrested by Uttar Pradesh police in March this year.

The court had on August 31 taken a serious view of the incident and sought a report from the authorities after Salman appeared before it with a bandaged face and alleged he had been assaulted.
