DMK wants Chief Minister Jayalalithaa to resign

DMK has asked for the resignation of Jayalalithaa following the rejection of her plea for exemption from personal appearance in the court in the wealth case in Bangalore.

The DMK has asked for the resignation of Jayalalithaa as the Chief Minister of Tamil Nadu following the rejection of her plea for exemption from personal appearance in the court in the disproportionate wealth case in the Bangalore  Special Court.

“Her continuation as chief minister has become untenable following the court’s directive to her asking for personal appearance for cross examination. She should resign on moral grounds,” said T K S Elangovan, MP and  official spokesman of the DMK.

He told DNA that no chief ministers has been asked by  the courts in the country to appear before them for cross examination in connection with criminal cases.

“This is a criminal case filed against Jayalalithaa for possessing wealth disproportionate to her known sources of income. She has been charged under sections dealing with corruption . This is the first time a chief minister is appearing for cross examination in a criminal case,” Elangovan said.

But Vijayadharini, a Congress MLA who is also a senior  lawyer said there was no need for Jayalalithaa to resign in the backdrop of the court directive.

”She has been asked to be present personally in the court for cross-examination. There is nothing abnormal in the court asking a government official or chief minister  to be present in the court for personal hearing, If she appears in the court it will hasten the process of the case  and it could be wound up at the earliest. This will be beneficial for both the defendant and the petitioner,” said Vijayadharini.

 A Madras High Court senior advocate also said there is no justification for asking Jayalalithaa to quit following the special court directive.

"Ëven if the court rules against her, Jayalalithaa need not resign. She can always approach the apex court  and she need quit only if the supreme court rules against her,”said the advocate who did not want her name to be quoted.
