A Delhi court today awarded 10 years' rigorous imprisonment to a man for repeatedly raping his minor daughter, terming the incident as 'gruesome and abhorring act' which left a permanent scar on the victim.

A Delhi court today awarded 10 years rigorous imprisonment to a man for repeatedly raping his minor daughter, terming the incident as "gruesome and abhorring act" which left a permanent scar on the victim.

"An act of rape is a gruesome and abhorring act. But when this act is committed by a father upon his own daughter, then it leaves a permanent scar on the personality of the child, inhibiting growth and development.

"It instills a feeling of fear, insecurity and a brooding sense of shame and guilt for no fault of the victim," additional sessions judge Sunita Gupta said.

The court, which also imposed a fine of Rs10,000 on convict Hoshiyar Singh, quoted noted writer Sigmund Freud to drive home the point that the father is the protector of a child.

"I cannot think of any need in childhood as strong as the need for a father's protection. These words of Sigmund Freud clearly shows that fatherhood is a socio-moral process. It is intertwined with position and role of a father in society," the court said while refusing to take a lenient approach in sentencing the convict.

The victim, a school going child, had narrated her dreadful experience and the entire incident to her class teacher and the Principal, who in turn, ensured the registration of FIR against her father.

The court referred to the complaint lodged with the police in which the victim had alleged that her father who was not on good terms with his wife, raped her on the evening of February 6 last year.

The accused also forced himself on to her repeatedly and threatened against disclosing the incident, it said.

"Considering the facts and circumstances detailed above, coupled with the aggravating factor that a gruesome act was committed by the convict, by which he had not only defiled the body of victim, but also put an indelible mark on her person which shall haunt her throughout her life that she is a victim of rape committed upon her person by her own father, as such the convict does not deserve any leniency in punishment," it said.

The court rejected the plea of the accused that he was implicated by his estranged wife because he was opposed to her illicit relations.

"Accused is none else but the real father of victim, there is absolutely no reason for her to falsely implicate him in such a serious and heinous case," it said.
