Delhi high court rejects protection to couple in incestuous friendship deal

Bollywood actors are not alone in saying ‘we are just friends’ when they are actually seeing someone. A Delhi man has in fact gone a step beyond and signed a “friendship agreement” with his sister-in-law.

Suresh and Pratibha (names changed), who inked the deal on January 4 after six years of knowing each other and started living together immediately, have moved the Delhi high court (HC) justifying their “anti-social” relationship and seeking protection against threat from the girl’s family. They apprehend legal action by the girl’s father, who has lodged a ‘missing’ complaint with police and accused Suresh, 25, of kidnapping Pratibha, 22.

Hearing the unusual case, justice Hima Kohli blasted the lawyer for the couple, and said, “Have you [couple] forgotten the rituals of our society? Just to remind both of you, this is India, not America. Such relationships don’t have space in our society.

“It seems that you [the couple] have no shame. Prima facie I think such relationships are not valid under the law.”

In the agreement, the two have stated that since they know each other for the past six years (since Suresh’s marriage to Pratibha’s sister Kirti) and have good understanding, they mutually agreed to live together as friends forever.

Suresh, an employee with a private firm, has two children from Kirti and claims threat from her family as they are living apart.

Rejecting his lawyer’s submission that Kirti had no problem with Suresh’s relationship with Pratibha, the court said, “This is not done. Where will the wife go with the kids? How will she survive? What if the wife has no problem, society has certain objections.

The court, while refusing protection to the duo, directed police to explain provisions under the law for such relationships and file a status report by July 26, the next date for hearing.
