CWG scam: Businessman accused in street lighting case denied bail

A Delhi court on Friday rejected the bail of a businessman, arrested for his alleged role in a corruption case involving award of a contract to upgrade the city's street lighting before the 2010 Commonwealth Games to his firm.

Special CBI Judge Pradeep Chaddah rejected the bail plea of JP Singh, the director of Sweska Powertech Engineering Pvt Ltd, which was allegedly illegally awarded the contract, which led to a loss of Rs1.42 crore to the exchequer.

While denying him the bail, the court noted his earlier bail plea too had been rejected on July 2, 2011 and there was no change of circumstances to warrant him bail now.

In July 2011, Singh was denied bail as the court was of the opinion that "he was a man of means having 70 employees working under him and so he would try every trick to thwart the course of justice."

The court rejected the argument put forth by Singh's counsel PK Dubey that the CBI had initially estimated the loss at Rs3.62 crore but in the final charge sheet the loss was scaled down to Rs1.42 crore, which can be considered a change in circumstances.

"Rs1.42 crores is not a small figure. None of the public servants/conspirators would have earned even half of this amount as legitimate salary for his entire career," the court said.

Singh, along with Sweska's director TP Singh, MCD Superintendent Engineer DK Sugan, Executive Engineer OP Mahala, Accountant Raju V and civic body's tender clerk Gurcharan Singh are accused of corruption in upgradation of the city's street lighting system before the 2010 games.

The court had on March 12 framed charges against Singh and others for criminal conspiracy, cheating and forgery under the IPC and various provisions of the Prevention of Corruption Act.
