City lawyer fights for Sarabjits

Ahmedabad-based advocate MK Paul will move a petition at Delhi high court on Monday for the release of 14 Indian prisoners in different jails of Pakistan.

A large number of Indians in Pakistani jails have been languishing for years together. Taking note of the plight of these prisoners in jails across the border, Ahmedabad-based advocate MK Paul will move a petition at Delhi high court on Monday for the release of 14 Indian prisoners in different jails of Pakistan and providing compensation to their
family members.

A petition would also be filed for providing compensation to five persons released from Pakistan jail during different dates and whose families are living in abject poverty.

"The three prisoners namely Sunil Fazal, Prakashchand and Ratanlal who were released from Pakistan jails would be made party in the petition demanding compensation from the concerned authorities in this connection," said Kishore Paul, high court advocate and son of MK Paul.

Kishore Paul said that the fourteen prisoners also include Sarbjit Singh and and Kuldeep Singh Yadav lodged in a jail in Pakistan for years.

Sunil Fazal, a resident of Dhandwan village in Gurdaspur was sent to Pakistan as a spy. Talking to DNA, Fazal said, "I was sent to Pakistan by Military Intelligence and I used to visit Pakistan regularly since 1990. I worked for the nation for nine years as a spy for Military Intelligence."

Fazal was arrested on February 3, 1999 at Shakargarh in Pakistan and was sentenced for eight years in Pakistan. However, on December 23, 2006 Fazal was released after government of the two countries agreed to exchange prisoners.

Fazal also said that while he was in jail, the government did not take care or support his
family members.

Moreover, after he was released, the Indian army also refused to acknowledge that they had sent Fazal to Pakistan for spying.

Advocate Kishore Paul further said that they are moving a petition in Delhi high court for compensation on the ground of judgments passed by Delhi high court and Gujarat high court for providing compensation to the family members of the ones in Pakistan jails. The Delhi high court in order dated 31/05/2000 and 11/12/2001 had ordered government to provide compensation of Rs6.5lakh and Rs5lakh to Rooplal Sharia and Balwan Singh respectively.
