CBI rules out foul play in Bihar engineer's death

CBI has ruled out any foul play in the death of an engineer in Sitamarhi district of Bihar which had sparked off wide-spread agitation in the state but recommended departmental action against district and police officials for negligence.

In its preliminary report, submitted to the state government, CBI has said that the death of "Yogendra Pandey on June 18, 2009 was suicidal in nature."

"The evidence and circumstances indicate that he voluntarily took this extreme step in a defeated and demoralised state of mind," CBI spokesman said in a release here today.

The CBI has recommended departmental action against Superintendent of Police Kshtranil Singh, an IPS officer of 2005 batch, district magistrate Bishwanath, an IAS officer of 1994 batch besides legal action against the local contractor of Sitamarhi Kishore Singh.

The investigating agency also concluded in its report that former SP and DM had "failed to provide necessary security to the deceased, who was being harassed by the contractor of a Sitamarhi-based Construction Company and was assaulted by criminal elements while he was on duty."

"Pandey took the extreme step because of altercation with contractor of a Sitamarhi-based Construction Company, who along with his associates manhandled him on June 6, 2009 after the firm was debarred from work due to non-performance.

"(The accused did) not get police protection even after the incident despite repeated requests to the DM and SP," the CBI report said while listing reasons for his death.  The CBI, which based its report on analysis of forensic reports, post-mortem report, evidence collected at the scene of occurrence, said the deceased was also suffering from ill health owing to acute hypertension, diabetes and piles."

The preliminary enquiry was registered on June 27, 2009 on the request of Bihar government which had asked the CBI to enquire into the Dumra police station case relating to the unnatural death of Pandey, executive engineer.

State chief minister Nitish Kumar had directed the state home department to recommend to the Centre a CBI probe into alleged murder of Pandey in order to defuse the growing crisis after nearly 20,000 engineers in the state had threatened to go on an indefinite strike.

Pandey, executive engineer of Sitamarhi Road Division died on June 18 after falling from the collectorate building. Even though a suicide note was recovered from him, his family members had claimed that he was pushed from top of the building.
