The court has asked the authorities what steps they had taken in the matter of Dr Narendra Amin who had allegedly smuggled a tape-recorder into prison.
The special CBI court on Monday took cognisance of a petition filed by NV Chauhan and issued notice to the jail authorities. The court has asked the authorities what steps they had taken in the matter of Dr Narendra Amin who had allegedly smuggled a tape-recorder into prison, against the rules of the jail manual. Both Chauhan and Amin are police officers and are currently lodged in Sabarmati jail as accused in the Sohrabuddin Sheikh fake encounter case.
The matter pertains to Amin recording a conversation about the case between Chauhan and another inmate. Amin had recorded the conversation with a tape recorder allegedly to provide evidence to the CBI which is investigating the case.
In his application, Chauhan has stated that Amin had managed to smuggle the recorder into the jail. As this was against the regulations of the jail manual, a case should be registered again Amin at the local police station. Chauhan has also asked the court to direct the jail authorities to register an offense at the Sabarmati police station.
Chauhan's lawyer said after Monday's hearing that earlier the court had not taken cognisance of Chauhan's petition when it was filed on August 26. But on Monday Chauhan had filed another petition in response to which the court had issued notice to the jail authorities. The court will now hear the case on September 14.
Meanwhile, the special CBI court on Monday adjourned the hearing on Amin's petition seeking permission to turn approver in the case because the same matter is pending before the Gujarat high court. Hence the hearing on Amin's application was also adjourned to September 14.
