C'Wealth Games scam: Delhi court reserves bail plea order of M Jayachandaran

The ex-Joint Director General (Finance) of the Organising Committee has been accused of manipulating the minutes of the OCFC meeting in furtherance of the conspiracy to favour the Swiss firm.

A Delhi court today reserved for June 15 its order on the bail plea of CWG scam accused and ex-Joint Director General (Finance) of the Organising Committee M Jayachandaran.

Special judge Talwant Singh questioned Jaychandran if he had ever pointed out the huge difference in the bid from Swiss Timing, which was awarded the TSR (timings, scoring and result system) contract, and the escalated budget amount which caused a loss of over Rs 90 crore to the exchequer.

"Did you ever point out from where the excess amount of Rs 90 crore over and above the budget would come from?" the judge said.

To this, Jaychandran's counsel replied he was a part of the 8th, 9th and 10th OC Finance Committee (OCFC) meeting, none of which ever considered the financial aspect of the TSR contract.

"All that the OCFC meetings considered whether Pan-American and Olympic Games should be included in the eligibility criterion for TSR bidders," he contended.

Jaychandran, accused of manipulating the minutes of the OCFC meeting in furtherance of the conspiracy to favour the Swiss firm, reiterated that he had "amended the minutes on the orders of his seniors as he was duty-bound to do so."

Countering the charge, Jaychandran's counsel pointed out that none of the prosecution witnesses has named him in any major decision concerning manipulation of the contract.

"One of the witnesses had even said that it was OC's sacked chairman Kalmadi who had convened a meeting after two bids were received from Swiss Timing and MSL Spain and directed that Swiss Timing be given the contract," he submitted.

Jayachandran told the court that contrary to CBI's charge that he had manipulated the records, he merely prepared the minutes of the OCFC meeting on the basis of the notes taken by Bharat Prasad, Deputy Director General Finance and another person.

CBI had been opposing his bail on the ground that he had evaded investigation and alleged that when co-accused and OC former Director General VK Verma made false statement regarding the budgetary provision for TSR in the executive board, Jaychandran deliberately did not reveal the true facts.

Jaychandran was sent to jail on June 4 after he surrendered a day earlier before the court which had issued a non-bailable warrant against him on May 23.

The order on anticipatory bail plea of A K Reddy, the promoter of Hyderabad-based AKR Construction, will also be pronounced on June 15.

AKR Construction was sub-contracted the TSR work by Gem International which, in turn, was a sub-contractor of Swiss Timing.
