Batla House encounter case sent to sessions court for trial

The court provided a copy of the charge sheet to IM suspect Shahzad, the lone arrested accused who had absconded after the encounter at Batla House on September 19, 2008.

Paving the way for start of trial in sensational Batla House encounter in which a Delhi police inspector was killed in 2008, a local court today sent the matter to a sessions court for framing of charges and subsequent proceedings against a suspected Indian Mujahideen.
   
"The judicial file be sent to the district and sessions judge concerned," additional chief metropolitan magistrate Kiran Bansal said on conclusion of the procedural formalities.
    
The court provided a copy of the charge sheet to IM suspect Shahzad, the lone arrested accused who had absconded after the encounter at Batla House on September 19, 2008.
    
District and sessions judge Gurdeep Kumar will hear the matter on May 26.
    
Besides police inspector MC Sharma of Delhi Police's Special Cell, two IM suspects Atif Ameen and Mohd Sajid, who were holed up in the flat, were also killed in the gunbattle.
    
Fourth accused Ariz Khan is still absconding in the case which was registered with Jamia Nagar police station here.
    
Police had on April 28 filed the charge sheet against Shahzad, Ariz Khan (absconding), Atif Ameen and Mohd Sajid, accusing them of killing inspector Sharma on September 19, 2008, six days after the serial blasts here.
    
A team of Anti-terror cell of Delhi police had raided a house at Batla House following a tip-off that suspected Indian Mujahideen terrorists, allegedly involved in the serial blasts in the capital on September 13, 2008, were hiding there.
