Babri Masjid demolition case just an incident: SC

Supreme Court said this while listing CBI's plea for levelling charges of criminal conspiracy against LK Advani, Bal Thackeray and others.

Deferring the hearing to March end in a law suit filed by the CBI seeking invoking of grave charges of criminal conspiracy against BJP leader LK Advani and eight others in the demolition of Babri mosque case, the Supreme Court on Monday said there’s “nothing famous or infamous” about the case.

“It was just an incident’’, the court observed while retorting to the averment made by CBI counsel who said the matter relates “the famous” case of demolition of Babri mosque on December 6, 1992. Adjourning the hearing till March 27, a bench of justices HL Dattu and CK Prasad observed, “What is famous about it? It was an incident, which happened and parties are before us. It is not famous or infamous’’.

Since many of the parties to the case had not filed their response, the court asked them to complete the pleadings so that the matter is disposed of accordingly.

In March last, the court had issued notices to 21 people including Advani, Shiv Sena chief Balasaheb Thackeray, former UP CM Kalyan Singh, MM Joshi, Vinay Katiyar, Ashok Singhal, Giriraj Kishore, Sadhvi Ritambhara, VH Dalmia, Mahant Avaidhynath, RV Vedanti, Param Hans Ram Chandra Das, Jagdish Muni Maharaj, BL Sharma, Nritya Gopal Das, and others.

The present proceedings relate to a challenge to May 21, 2010 judgment by Allahabad High Court upholding a special court’s decision to drop the grave charges against the leaders or BJP and its like minded parties or organisations. The CBI has insisted that among others Advani, Joshi, Thackeray and Uma Bharti ought to be charged with conspiracy. It has referred to bifurcation of the trial and said HC verdict is completely erroneous in law.

“The offence of instigation, facilitation, actual demolition of the disputed structure and continuous assault on media persons all form a single transaction,” it said.

Meanwhile, the investigating agency that examined the Liberhan Commission findings has told the government that it doesn’t want to file any fresh FIR or supplementary charge sheet in the ongoing case against the alleged destroyers of the structure.
