Alimony can’t be denied even if woman can earn

A man cannot refuse to pay maintenance to his estranged wife on the ground that she is capable of maintaining herself, a Delhi court has said. Additional sessions judge RK Jain rejected the appeal of a man who had contended that his estranged wife was qualified enough and could look after herself. The man claimed his wife used to earn Rs10,500 per month but due to pregnancy lost her job. He submitted that she was competent to get employment again and maintain herself.
