A rights activist has questioned the charge by the entre and Chhattisgarh government that false petitions were being filed by non-existent persons to discredit them in their fight against Naxalites and said all the petitioners are alive.

The Centre and the state government had alleged one of the petitioners Madhavi Hurre, who claimed to be a victim of police atrocities on tribals caught in cross-fire with Naxalites, was "non existent."

The affidavit filed by rights activist Himanshu Kumar, who is also a petitioner in the matter, said the existence of Hurre is beyond doubt as she herself had narrated the story of police attorcities at a press conference in Delhi and news magazine Tehelka had carried her interview.

However, when the matter came up before a Bench comprising justices B Sudershan Reddy and SS Nijjar, Chhatisgarh government raised strong objections to the claims made by Kumar in the affidavit.

Senior advocate Ranjit Kumar and Atul Jha, appearing for the state government, alleged the rights activist was trying to mislead the court as in the petition the address of Hurre is different from what it has been mentioned in the affidavit.

They said that while in the petition, the tribal is referred to be belonging to Gachanpalli village, the affidavit has named another village Singhanpalli in Dantewada district, the distance between the two being around 15 km.

The state government also submitted the name of the petitioner's husband was different in the petition and the affidavit.

During the brief proceeding, senior advocate Colin Gonsalves, appearing for the tribals, said a crucial matter was involved and it requires detailed hearing.

The Bench posted the matter for further hearing on August 11.
