Absconding builder deported from Canada, held in Ahmedabad

The Canadian government deported a builder, Saurabh Patel, who was one of the defaulters of Charottar Nagrik Sahkari Bank Ltd. When Patel arrived in Ahmedabad from Canada on Wednesday, he was immediately arrested by CID (crime).

The Canadian government deported a  builder, Saurabh Patel, who was one of the defaulters of Charottar Nagrik Sahkari Bank Ltd. When Patel arrived in Ahmedabad from Canada on Wednesday, he was immediately arrested by CID (crime).

The police had earlier issued a red corner notice against Patel in connection with a case of cheating filed against him. As per the details of the case, Patel had taken a loan of Rs2.75 crore from the Charottar Nagrik Sahkari Bank Ltd to build Shaily Towers in Satellite.

He was booked for cheating and under various other sections of the IPC when he failed to repay the loan. A complaint in this connection was registered against Patel and three others on June 20, 2002. In the chargesheet filed in the case, the state CID had shown him as an absconder.

The court had subsequently issued a warrant against him. When the police failed to track Patel, a red corner notice was issued against him.

On Tuesday, Patel's lawyer, Manish Patel, had filed a petition in the magistrate court for cancellation of the arrest warrant issued against the builder. In the application, the advocate stated that Patel had already deposited the amount he owed in the Gujarat high court on April 15, 2011.

Moreover, the dispute with the Shaily Towers society had also been settled as he had paid a sum of Rs21 lakh to the complainants, the petition said. It added that the trial against the three other accused in the case had also concluded and they were acquitted on June 30, 2009 due to lack of evidence.

The petition filed by the builder's lawyer further stated that the FIR against him was lodged much later. By then, Patel had already shifted to Canada with his family. Hence as there was no dispute pending against him, the warrant against him should be cancelled, the petition said.

But the metropolitan magistrate's court, however, rejected the petition after hearing both the sides on the ground that Patel had been absconding for long and had left the country.

After the builder's petition was rejected, CID (crime) moved in and on Wednesday morning arrested Patel when he reached Ahmedabad after being deported from Canada.

According to the details of the complaint lodged by the members of the Shaily Towers society, Patel had taken a loan from Charottar Nagrik Sahkari Bank Ltd for the construction of the said building. The building was built and all the flats were sold but the builder failed to repay the loan. 

After handing over possession of the flats to the owners, he left India without completing the required formalities. The bank pasted a notice about default on loan pasted on the wall of the building. When the residents inquired about it, they were told about the loan default after which they filed a complaint.
