SC judges against CJI | CJI, 4 judges meet again, no breakthrough

Meeting the Chief Justice of India (CJI) Dipak Misra for the second time this week, four senior Supreme Court judges put forward a resolution leaving the ball squarely in the CJI's court. Justices Jasti Chelameswar, Ranjan Gogoi, Madan Lokur and Kurian Joseph, met CJI Misra on Thursday morning for at least 20 minutes before their day at court began.

While none of the four judges has since addressed the media, DNA has reliably learned that a proposal has been forwarded by the four and now it is up to CJI Misra to take a call.

Last week, the judges had held an unprecedented press conference in which they highlighted the manner in which the CJI had breached institutional integrity and tinkered with well-established systems. Their decision to go public came after their efforts to convince the CJI to take corrective measures failed. Since then, the corridors of the apex court have been rife with speculation and rumours.

On Tuesday, CJI Misra had extended the olive branch and reached out to the four judges for the first time since the press conference. Sources said the CJI's move could also be connected to the fact that the government had put the onus of setting his house – the highest judiciary – in order on him.

A day after their public criticism, the four judges received support from several jurists, a former Supreme Court judge and three retired judges of high courts, who wrote an open letter to CJI Misra, asking him that all sensitive and important cases, including pending ones, should be dealt with by a Constitution Bench of the five senior-most judges only.

In their letter, former SC Judge PB Sawant, former Delhi HC CJ AP Shah, former Madras High Court Judge K Chandru and former Bombay HC Judge Hosbet Suresh have expressed concern over the improper allocation of cases to preferred benches by the CJI.
