Indore: Custody row: 10-year-old rape victim's mother files plea in HC

Public prosecutor claimed that the victim's mother had turned hostile and intends to change the statement of the girl by taking her custody.

The mother of a 10-year-old girl who was brutally raped for 75 days filed a petition with the High Court on Wednesday demanding custody of her daughter who has been kept in children home without her consent since June 2013.

However, the public prosecutor claimed that the victim’s mother had turned hostile and intends to change the statement of the girl by taking her custody.

Laxmi lodged the petition through advocate Dharmendra Chelawat who told dna that the girl is a minor and only 10-years-old. She is a victim of brutal rape and has been ordered to be kept in the children home without consent of her parents since June 2013.  “She is not being handed over to her parents despite repeated requests and proceedings,” said Chelawat.

In the petition, it has been stated that the girl was ordered to be kept in the children home under Section 4(3) of Protection of Children from Sexual Offences Act 2012.

Her father had filed an application before the trial court on December 6, 2013 requesting the court to return their daughter. However, the application is still pending and no action had been taken despite repeated requests.

Meanwhile, public prosecutor Ravindra Desai alleged that the parents of the victim have reached an agreement with the accused Sunil Karosiya as they are still working at his farm house.

“They are trying to get the custody of the girl just to change her mind and statement. The girl should not be permitted to go out of children home till the trial gets completed in the case,” said Desai.

The victim used to work as a labourer in the farm house of Karosiya. The accused allegedly took her to his flat located at Rajkamal Regency and outraged her modesty for 75 days till June.  He had fled after the incident came to light and was arrested by the police on October 31, 2013.
