Delhi: Serial rapist renders $41.2billion corporation Uber Cabs impotent

A psychopath serial rapist has rendered a $41.2 billion MNC impotent in several parts of the world. That is the story. The psychopath rapist commits a rape, and when apprehended, tells the police 'I made a mistake, what can I do? Let me go.' But the MNC which called him to earn a few bucks for both of them is now paying for its mistake!

Three days after cabbie Shiv Kumar Yadav raped a woman executive of an MNC in his Uber-booked cab, the international cab booking company has been banned in Delhi, and faces a similar fate in the nine other cities in India including Mumbai.

The police on Tuesday, lodged an FIR (No. 1300, Sarai Rohilla Police Station, north Delhi) against Uber under sections 420, 188 read with section 34 of the IPC. Delhi Police commissioner BS Bassi said the police were examining if there was any legal liability for Uber in the rape case. And the National Commission for Women (NCW) has issued summons to Uber CEO.

The NCW also issued a suo motu notice to Delhi Police. "I've spoken to police commissioner BS Bassi. We've issued a suo motu notice to Delhi police seeking a reply in 15 days. We've also issued a notice to Uber CEO in the case involving one of its drivers.

Uber is not only in trouble in India. World-over Uber is getting a bashing, from homeground San Francisco to Manila in Thailand. "It's not the first time that Uber drivers have been accused of sexual assault," noted the Time magazine, adding that the "war chest" of the $41.2 billion company "will come in handy" in these battles including in Toronto in Canada, in Germany, in the UK, in Thailand and Vietnam.

And while this was happening on the global stage, the government of India went one step further and instructed all states and UTs to halt all web-based taxi services, and see to it that such service providers remained off the roads till they got themselves registered.

Union home minister Rajnath Singh read out statements in both Houses of Parliament to set the record straight. The move to ban web-based taxi services came from the home ministry whereas, ideally, the onus should have been on the ministry of transport. But with women's safety a sensitive issue, and with the Delhi assembly elections round the corner, the government did not want to dilly-dally, or take chances. On Tuesday, Singh also held lengthy discussions with Delhi Police commissioner BS Bassi, who was also summoned for a meeting with national security advisor Ajit Doval.

The only person who spoke words soothing to Uber and other web-based cab booking apps was transport minister Nitin Gadkari who said banning such service providers was not the answer or solution.
Tuesday also saw Yadav grilled by the police. The 32-year-old was placed in police remand for three days by a local court on Monday. And what he is telling the police is the story of a psychopath serial rapist with neither remorse nor guilt.

Yadav likes to play with guns too

It so happens that Shiv Kumar Yadav has had two other rape cases against him before this one, plus a molestation case. And in this latest instance of rape, Yadav was canny enough to use the Nirbhaya gang-rape template to scare the 27-year-old rape survivor into submission. His threat to 'Pet mein sariya gusa doonga' effectively finished off any last resistance in her. Everybody knows what rapists of Nirbhaya did to her. They shoved an iron rod into her intestines. Yadav used the threat of a similar outcome, to scare the 27-year-old rape survivor.
The FIR lodged against Yadav at a north Delhi police station tells the story in sordid detail. Yadav started his sexual-assault career with molesting a girl in his village Ram Nagar in 2003, when he was 21. He is out on bail in that case.

Yadav also likes to play dangerously with guns. He was arrested under the Arms Act in 2006. And from 2003 to 2009, he was arrested several times under the Goonda Act. He is out on bail in these cases. "Yadav's criminal history reads like that of psychopath's. He has a history of terrorising women in village in Mainpuri. He is beyond reform," said a police officer.

"A case of forgery and using fake certificates under section 466, 468 and 471 IPC has also been registered against Shiv Kumar Yadav in north district. He used a forged police verification certificate for getting a tourist permit for his cab from the Delhi Transport Authority," DCP North Madhur Verma told media. "He was arrested for molestation in 2003, Arms Act in 2006, rape & robbery in 2013. He was out on bail from a UP court when he committed this rape. His criminal career starts from when he was 21. It turns out that accused Shiv Kumar Yadav is a big time rogue of Mainpuri in Uttar Pradesh."
Yadav, who married his dead brother's widow, has three children. The eldest is 14. It was to his wife that he ran to after committing the rape. She told the police he told her he had been involved in a fight. The police said there is no love lost between him and his parents, who disowned him more than a year ago for his wayward ways. His father is 74, and saddled with taking care of another son who is mentally challenged. His mother says if her son is guilty, punish him.
