Hilary Duff's ex-husband Mike Comrie, who was under investigation for alleged sexual assault, will not be charged with rape.

A spokesperson for the LA County District Attorney's office confirmed to E! News that the case was dismissed due to insufficient evidence.

In February, TMZ Sports reported that the former NHL hockey player, who has a 5-year-old son Luca with Duff, had been accused of sexual assault after he allegedly invited two women to his Los Angeles home for drinks.

Duff, 29, and Comrie, 36, parted ways in January 2014 after nearly four years of marriage. Their divorce was finalised in February last year.
