Noida: Kid falls into shaft, FIR against Jaypee

Helpless father blames builders for poor construction; residents register case against the management

When eight-year-old Aarav Beniwal fell into the shaft while playing in Jaypee Wish Town Klassic on Monday, his father's dream of providing him with a safe environment was shattered. By his own admission, Yashpal Beniwal had bought a flat in the upscale society in Sector 134 for the amenities like playgrounds, parks, and clubs.

Around 7 pm, Aarav was playing when he accidentally hit the ventilation screen built in the middle of the park. The cement screen gave away and as a result, the boy fell down, 20 to 25 feet, to hit the floor of the building's double basement. He sustained serious injuries in his head and limbs. He was with his mother at the time of the incident but the helpless mother couldn't do anything to prevent the boy from falling. He is now struggling for his life at a private hospital in the vicinity.

When I came to know about the incident through the security guard, I rushed to the spot immediately. I went inside through the water pipe, but could not take my son out. He was rescued after the fire department and the police arrived," he added.

He said that the rescue operation took over an hour because the shaft's breadth is not more than 3 feet. He explained that the lack of space was the main hurdle in rescuing the child.

"This is the builder's fault. My son is in critical condition because the builder used bad quality of material," he added.

The residents complained of poor quality material used in the construction of the cement screen that fenced a 6 square feet ventilation shaft. Residents complained that they were always worried about the screens which were brittle. "Even a gentle push would result in the screens crumbling. We had taken up the issue with the builders, but they never responded," the residents alleged.

The child's father, Yashpal Beniwal, and at least 70 other residents filed a case against the builder and the Japyee management. The police have registered an FIR against Manoj Gaur, managing director of Jayprakash Associates, and two members of facility management group, Ajit Sharma, and Ravindra Badhesra.

They have been booked under IPC Sections 288 (negligent conduct with respect to pulling down or repairing buildings), 336 (act endangering life or personal safety of others), 337 (causing hurt by act endangering life or personal safety of others and 338 (causing grievous hurt by act endangering life or personal safety of others).
