Man accused of poisoning wife gets bail

A man who has been accused of killing his wife for dowry by poisoning her drink was granted bail by a Delhi court.

Additional Sessions Judge Sukhvinder Kaur granted bail on a bond of Rs 1 lakh after it found no prima facie evidence to substantiate the man's conviction regarding the demand for dowry.

"Further, in view of the subsequent opinion on the postmortem report given by the concerned doctor, prima facie it does not seem to be a case of homicide as well," the court said.

According to the complaint filed by the parents of the deceased, Ruchi Agarwal was married to Vineet Aggarwal on November 16, 2016, but her in-laws did not treat her well.

On February 17, Ruchi's mother-in law Babita called her father Vijay Kumar and informed him that Ruchi was not well.

On reaching his daughter's house, Kumar found that his daughter was lying still. She was taken to the doctor who declared her as brought dead.

Advocate Pradeep Rana, appearing for the accused, said that the post mortem report given by the investigating officer stated that there was a presence of methyl alcohol in her blood stream, which cannot be given deceitfully as it has a pungent smell.

Rana's contention was confirmed by the Forensic Lab report who reported the presence of methyl alcohol, contradicting the police's claims that she was poisoned.       

Rana also said that since there were no injury marks on the body of the deceased, his client was being falsely implicated.

The court also took on record the submission of the Investigating Officer (IO) who stated that all the dowry money was spent by the accused's family since he was suffering from epilepsy.

Investigations also found that the deceased was suffering from some ailment and whenever she fell ill, she would go to her parent's house and take some herbal cure from a temple near her place.

Earlier, the parents of the accused had been granted bail by the court in connection with the same matter.

INVESTIGATIONS

The post-mortem report showed the presence of methyl alchohol in her blood stream, which could not have been administered deceitfully as the element has a pungent smell.
