Delhi HC to duo: Why act like Bhagat Singh?

Raising questions about the actions of two youths who threw pamphlets in the state Assembly, the Delhi High court on Monday asked them as to why were they trying to act like Bhagat Singh and portray themselves as freedom fighters.

The observation came while hearing a habeas corpus filed by a duo Jagdeep Rana and Rajkumar Madan challenging the one month imprisonment order by the Delhi Assembly speaker Ram Niwas Goel for throwing pamphlets and raising slogans in the assembly on June 28 this year. 

A bench of Justices Siddharth Mridul and Najmi Waziri questioned their activism and asked whose attention they wanted to draw by throwing the pamphlets.  

The court asked about the maintainability of the petition stating that how a habeas corpus can be maintained in the instant situation. It also added that the Legislative Assembly of National Capital Territory of Delhi Rules of Procedure and Conduct of Business 2002 were not followed, then the matter may have to go before another bench.

The petitioners had demanded that the order be cancelled because it was passed when they were in hospital. 

According to the plea, on June 28, the petitioners seated in the visitors’ gallery threw pamphlets and raised ‘Inquilab Zindabad’ slogans in the Delhi Assembly. While they were being marshalled out on the directions of Goel, AAP MLAs thrashed and injured them.

Both were then arrested on the order of the Speaker, who sentenced them to 30 days in prison. The plea alleged that the two were not given a chance to put forth their point and that their sentence was illegal.  The plea had stated: “The petitioners wanted to attract the attention of the party and the government to some glaring issues by throwing printed pamphlets in the Vidhan Sabha during the session. They had no intention to breach the privilege of the Legislative Assembly or to commit contempt of the same.”
