Stay on bail terms for Yeddyurappa’s kin extended

The high court on Monday extended the interim stay on the two bail conditions imposed on the kith and kin of the former chief minister BS Yeddyurappa by the Lok Ayukta special court in connection with the alleged illegal land denotification scam until December 8.

On October 15, the Lok Ayukta special court had issued an arrest warrant against Yeddyurappa and sent him to judicial custody until October 22. But it granted bail to his sons Raghavendra and Vijayendra and son-in-law Sohan Kumar in two private complaints on alleged illegal land denotifications.

The special court had imposed specific bail conditions to the kith and kin. First, they should furnish a clear statement of money transactions from the date of incorporation of the Dhavalgiri Properties and Adarsh Properties. This has to be certified by a qualified chartered accountant in seven days. Second, they should produce their bank accounts and details certified by the bank for the past three years in seven days.

The kith and kin then filed a petition in the high court, seeking relaxation in the bail conditions.

They contended that the special court has committed a grave error in directing them to submit the details of their private business transactions without considering that those transactions could be used against them as evidence during the trial.

Since the documents were public records, it was the burden of the complainant to prove this by producing all the relevant material before the court.

The case up for hearing on Monday and the interim stay was extended till December 8.
