High court to hear Karnataka CM's land scam case again

The final hearing of the case challenging the Lokayukta special court order seeking a probe of allegations of land scams against chief minister BS Yeddyurapa is set to resume on June 13.

Sohan Kumar, son-in-law of Yeddyurappa, had filed a writ petition in the high court challenging the February 26 Lokayukta order seeking an inquiry into the allegations against Yeddyurappa and his family members.

The high court, on March 29, stayed the Lokayukta special court’s order. Advocate Sirajin Basha moved the Supreme Court challenging the high court’s order of granting a stay.

The Supreme Court on April 29 dismissed the special leave petitions and directed that Basha could move the high court for vacation of stay. The bench said if a petition is filed, the high court ought to dispose it in of the same in six weeks.

Basha later moved the high court seeking vacation of the Karnataka high court stay on the Lokayukta probe against Yeddyurappa and his family.

Basha, in his five applications, submitted that Sohan Kumar had no locus standi to question the legality or the validity of the governor’s sanction order, either on behalf of the chief minister or in his stead, since he was not a public servant.

Justice KN Keshava Narayana adjourned the case to June 13 as the advocates representing Sirajin Basha and his fellow-complainant and advocate Balraj, have sought time to prepare their arguments.
