The third complaint registered against chief minister BS Yeddyurappa, charging him with corruption, came up for hearing on Tuesday at the court of the 23rd additional city civil and sessions judge, Chandrashekar B Hipparagi.

Advocate Vijayetha Nayak, arguing the case of Sohan Kumar, representing Davalagiri Estates, submitted an application under Section 210.

She said, “There is a compliant with similar accusations pending before the Lokayukta. We have submitted an application under Section 210 of the Criminal Procedure Code, to stay this case until that investigation is complete.”

CH Hanumantharaya, the advocate appearing for complainant Sirajin Basha, said, “One can notice that the advocates appearing for RN Sohan Kumar (the chief minister’s son-in-law, also an accused in the case), have filed applications only under Section 210 of the Criminal Procedure Code (procedure to be followed when there is a complaint case and a police investigation in respect of the same offence), and not under Section 319 (power to proceed against other persons appearing to be guilty of offence) as submitted in earlier complaints. We will file objections before the court on Wednesday, when complaint number four comes up for hearing.”

There was a heated argument between the advocates, as Hanumantharaya said that the application filed by Sohan Kumar was ‘frivolous,’ and meant only to drag the case.

The private complaint number was not given in this case, as certain corrections have to be made before the number is registered.

The 23rd additional city civil and sessions judge will hear the fourth and fifth complaints registered against the chief minister on Wednesday.
