Bangalore High Court disposes of writ petition to trace Ramya Shetty

The High Court on Tuesday disposed the habeas corpus writ petition seeking to trace Ramya Shetty (21) of Naringana.

In her statement, Ramya said that she had not been kidnapped, and that she had fled with Mohammad voluntarily. She refuted reports that she had been kidnapped with the intention of forcing her to convert to Islam.

A bench of the High Court headed by justice Sreedhar Rao, however, ordered the continuation of the inquiry that the police have been carrying out on Mohammad, who has been accused by Ramya’s brother Shiva Prasad of kidnapping his sister.

The police told the court that Ramya Shetty had confessed that she had acted in accordance with her own will, and that she had not been kidnapped. The case was disposed of on the basis of this confession.

Shiva Prasad, Ramya’s brother, had filed a writ petition on December 18, 2009, claiming that there was the possibility that his unmarried sister’s ‘abduction’ was an instance of ‘love jihad.’

Prasad had sought that his sister be traced and produced before the court.  Konaje superintendent of police Sunil G Patil had filed a nine-page report on the steps taken by the investigating team to trace Ramya Shetty. This report was rejected by the court.

Ramya Shetty had gone missing from her Dakshina Kannada home on December 4, 2009. Her brother claimed that he had lodged many complaints at the Konaje police station. He said that the police had shown no interest in acting on his complaints.

The accused, Muhammad, is a 40-year-old mason and father of three, who visited the Shetty home in Bantwaala in connection with masonry work.

Ramya’s brother alleged that she had been lured by the mason, who promised her employment in Kerala and intended to forcibly convert her.
