The Lok Ayukta police on Friday gave a clean chit to home minister R Ashoka in the case related to alleged illegal acquisition of land at Lottegollahalli.

However, the Lokayukta police’s B report said Ashoka had committed violation under Section 79-A of the Land Reforms Act, 1961, adding that action should be taken against the violation.

Ashoka is facing charges of illegally denotifying land in Lottegollahalli and registering it in his favour. The Bangalore Development Authority had acquired the land to form Raj Mahal Vilas (RMV) Layout II Stage.

In a private complaint filed in Lokayukta court, advocate Jayakumar Hiremath alleged that by illegally acquiring the land, Ashoka had caused a loss of Rs26 crore to the state exchequer.

Former chief minister BS Yeddyurappa was accused number two in the case.

In an earlier hearing, Justice NK Sudhindra Rao had ordered the Lok Ayukta superintendent of police, Bangalore Urban district, to submit the investigation report on December 16.

When the case came up for hearing on Friday, Lok Ayukta police submitted the 40-page B-report along with documents running into 1,400 pages in 10 volumes.

The police had examined 33 witnesses, the document
said.

According to their submission, there was no offence against Ashoka. However, the B report found violation under section 79-A, Land Reforms Act, 1961.

The ADGP of Lokayukta asked higher officers to write to the government about the violation. The ADGP also wrote a letter to the chief secretary proposing action against those involved in the violation.

 According to the B report, the BDA had acquired 18 guntas of land from a land-owner, Shamanna, at Lottegolahalli for the formation of RMV Layout II Stage in 2003.
 

The BDA had also acquired one acre and three guntas of land from another land owner Ramaswamy for the same purpose.  However, though the land was acquired for the layout purpose, of the 18 guntas of land, nine guntas was left out and of the one acre three guntas of land, 14 guntas of land was left out.
