On Gujarat Foundation Day, govt makes 24x7 shops a reality

By the time you wake up and read this on Thursday morning, shops and commercial establishments operating round-the-clock would have become a reality in Gujarat. On Wednesday, which incidentally was the state's 59th Foundation Day, the government issued a notification allowing shops and commercial establishments to remain open 24x7.

"The state assembly had passed the Bill to allow shops and commercial establishments to remain open 24x7 in February. The Bill has received assent of the Hon'ble President, and we have implemented it in the state from today itself to mark the occasion of Gujarat Foundation Day," Deputy Chief Minister Nitin Patel, told media-persons on Wednesday evening.

The new law would apply to the whole state, and not just the urban areas, he said further.

The Gujarat assembly had passed the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2019, during the budget session in February. It was approved by the governor in March.

Vipul Mitra, additional chief secretary of labour & employment department, said that since the model code of conduct is in force, the state government had taken special approval from Election Commission for notifying the law.

"The Act was notified after receiving the Election Commission's permission. Its implementation will start from tonight (Wednesday night)," he said.

With the law being implemented, shops and commercial establishments can run their businesses throughout the night. The deputy chief minister said the move would not only boost income of shopkeepers, but also generate new employment opportunities.

"Under provisions of the law, traders and establishments will also be relieved from getting registration annually, as they will be required to register only once," he said further.

Among other features, the new law allows women employees to work from 9:00 pm to 6:00 am, which was not allowed so far. The work shift would be restricted to 12 hours for the employees.

Shops and establishments employing 30 or more women would be required to provide crèche facility for their children.

In establishments where the number of employees is over 100, canteen facility would be required to be provided. The law also provides for levy of strict penalty on establishments for violating the rules.

New Provisions

  • Among other features, the new law allows women employees to work from 9:00 pm to 6:00 am, which was not allowed so far

  • Shops employing 30 or more women will have to provide crèche facility
