Bath-fitting co's arguments fail to hold water

A state consumer forum has asked a bathroom fittings company to compensate a customer for faulty body jets sold to him.

Apart from paying him Rs 17,000 by way of cost of the jets, the forum also asked the company to compensate him Rs 50,000 the cost he incurred in replacing the fittings and tiles with something else. The matter came up before the forum after a district forum in Ahmedabad ruled in favour of Jaquar and Company Ltd.

The matter pertains to one Avinash Patel, a resident of Isanpur, who got bathroom fitting worth over Rs 1 lakh of the company for his bathroom including four body jets worth over R16,974. This was brought from a dealer of the company.

The customer soon had to call a technician of the company as the fittings did not work properly. The technician sealed some of the holes in body jet so that the water pressure in the jets would improve. The company argued that this had to be done as the water flow and pressure was not enough.

The customer, unhappy with the district forum's verdict, moved the state forum seeking refund of not just the body get cost but also Rs 54,000 for the cost incurred by him in removing the fittings and replacing the tiles as well as Rs90,000 towards mental harassment and legal costs.

The company's counsel argued that the technician had after sealing 15 of the 35 holes in each body jet had ensured that the water being released from the body jet was adequate and the customer had also expressed satisfaction with the same in the job card.

The customer argued that he was sold a product with manufacturing defect as for the company's argument that there wasn't enough water pressure did not hold water as he had installed proper pressure pump to ensure that the water pressure was correct.

The state consumer forum in its order stated that the mere fact that the company's technician had to seal some of the holes in the body jet to ensure that water was released from the unsealed holes pointed out the fact that the bathroom fitting did not do what it had promised and there was some defect in it.
