‘Manohar Kadam deserves no sympathy’

 The state government on Wednesday filed an affidavit opposing the bail of convicted cop Manohar Kadam.

Kadam, who was sentenced to life imprisonment for ordering the firing on a Dalit mob at Ramabai Nagar in 1997, had moved the Bombay High Court seeking bail and the suspension of his sentence.

Additional public prosecutor Usha Kejriwal submitted an affidavit to the court on Wednesday. The affidavit filed by Jalindher Chavan, police sub-inspector attached to the special squad of the DCB CID, said that Kadam’s stand that he fired in self-defence did not come out anywhere during the trial when he was cross-examined.

The affidavit also stated that the trial court was absolutely right in showing “no sympathy” to Kadam and handing out the life imprisonment sentence to him.

As per the affidavit, Kadam claimed that the firing took place near LPG tankers which the mob was likely to set on fire. This was struck down by Ramchandra Singh, the head of the ballistic division of the CFSL.

Singh said that firing took place in a densely populated slum. Evidence shows that 50 rounds were fired by seven officers, the affidavit further stated. However, Kadam’s advocate Raja Thakre argued that he had not fired a single bullet on the day of the incident. Thakre pointed out that the sanction to prosecute Kadam under certain sections of the CrPC and the Bombay Police Act was not obtained.

He added that that if there is apprehension of threat to life or damage to property, the police can use force even if it risks causing death.

The court will continue to hear the arguments in the case on Thursday. Kadam was admitted to KEM Hospital after his conviction as he complained of acute chest pain. His lawyers said that he’s out of the hospital and currently lodged in prison.
