SC allows conditional de-sealing

NEW DELHI: A large number of traders here heaved a sigh of relief on Wednesday when the Supreme Court allowed unlocking of their premises, provided they agreed to abide by its final order on the legality of the Centre’s notification nullifying sealing orders.

The traders would have to submit affidavits and undertakings that they’ll comply with the court’s order. The issue will be heard on July 7. A bench headed by justice Arijit Pasayat said in cases where the Municipal Corporation of Delhi (MCD) had unlocked premises, owners had to give an undertaking within 10 days.

Civic body officials said the MCD was in the process of identifying properties that could avail benefits of the central government’s directive for de-sealing structures built before December 2006.

Earlier this week, the MCD had invited applications to avail of the scheme that provides relief under special laws. The civic body has requested the affected to submit applications to zonal deputy commissioners concerned for de-sealing their properties sealed for misusing residential premises for commercial purposes. The court’s interim relief is being viewed as a “major boost” to chief minister Sheila Dikshit’s government that is in election mode this year.

MCD commissioner AK Nigam says de-sealing would be undertaken for properties under various categories not covered by Master Plan 2021, including slum clusters, unauthorised colonies, village areas, schools, dispensaries, religious and cultural institutions, warehouses and farmhouses.

According to MCD sources, about 3,000 properties could be eligible for de-sealing under these categories. On January 30, the Centre paved the way for the MCD to begin de-sealing properties in unauthorised colonies, villages and their extensions, which were sealed before September 15 last year
