Bhosale case hearing on June 18

The Bombay High Court on Monday directed Pune-based hotelier and builder Avinash Bhosale to file an affidavit, in reply to a petition filed by Directorate of Revenue Intelligence (DRI) seeking cancellation of bail granted to him by a metropolitan magistrate’s court.

Justice VK Tahilramani has given time till June 11 to Bhosale to file the affidavit and the case will be heard on June 18. DRI had arrested Bhosale at the Chhatrapati Shivaji
International Airport in Mumbai on May 27 when he tried to evade duty on imported goods worth lakhs of Rupees. However, additional chief metropolitan magistrate (ACMM) SY Shisode granted him bail on the same day at 11.35 pm without even hearing the DRI.

The appeal filed by the DRI in the HC alleges that the ACMM did not have charge of a night magistrate on May 27 and was thus not entitled to grant bail. DRI has sought cancellation of the bail granted to Bhosale “as it was granted
without jurisdiction”.
Bhosale’s lawyer Amit Desai contended that the DRI was casting “serious aspersions” against a judicial officer. The court asked him to state his objections to DRI’s plea in an affidavit.
