Salem can drink mineral water in jail

Special Tada Judge P V Bavkar on Friday granted underworld don Salem's request to allow him Bisleri water, as the lack of potable drinking water in jail has led him to develop a skin infection.

Meanwhile, hearing the Pradeep Jain murder case, Judge Bavkar adjourned it to April 7, when charges against gangster Abu Salem, his driver Mohamed Hasan Mehndi, and builder Virendrakumar Jhamb would be framed in the case.

Arguing against the charges drafted by the Tada court, Salem’s lawyer Ashok Sarogi said charging Salem with offences other than those agreed upon in the Extradition order would constitute breach of an international agreement and the Indian laws.

“It would also amount retracting the guarantees given by India to Portugal from where Salem was extradited. This could lead to a lot of embarrassment for the Government of India (GOI),” said Sarogi. Salem has also challenged the breach of the Extradition Order in the Supreme Court which will hear the case on April 4.

Portugal had granted permission on GOI’s representation that Salem was a terrorist who ‘masterminded the 1993 Mumbai serial blasts’. Also the then PM, L K Advani, and the then Indian Ambassador to Portugal and the Minister of State for External Affairs, Omar Abdullah, had solemnly promised to abide by the terms of the Portuguese extradition order.

In the order Portugal had distinctly mentioned that in Jain murder case, Salem was to be tried only for murder/attempt to murder under the IPC and actual acts of terrorism/abetment under TADA and no other charges.

However, the draft charges framed by the TADA court include conspiracy (both under TADA and the IPC), possession of and transporting arms under the TADA and the Arms Act and charges under Explosive Substances Act and Explosives Act 1884 All these charges were expressly forbidden by three Portuguese courts in succession after studying the case presented by India.

In the Jain murder case, allegedly two unidentified gunmen shot builder Pradeep Jain on March 7, 1995 outside his house Brij Kamal in Juhu, at Salem’s behest. The case was first tried by a TADA court in 1997, against six accused. Seven accused including Salem were absconding. TADA court acquitted all six accused for lack of evidence.
