Cauvery water dispute: TN builds case to counter K'taka's review move

CHENNAI: Tamil Nadu has put caution before celebration over the Cauvery Water Disputes Tribunal award, as Karnataka will discuss formalities of a review petition at a cabinet meeting on Wednesday.

With the parties given three months for appeal and another 90 days after it is notified in the gazette, Tamil Nadu does not want to bare its cards too soon. Opposition AIADMK leader and former chief minister J Jayalalithaa, meanwhile, asked Karunanidhi to move the Supreme Court to get a bigger share of the Cauvery waters.

The first sign of TN’s guarded approach came when chief minister M Karuananidhi, who expressed his "extreme happiness" to reporters in Delhi on Monday afternoon, dubbed the award a "consolation" soon after he reached Chennai on Tuesday evening. "Karnataka has the right to do so. We will deal with it," is all Karunanidhi would say about Karnataka deputy chief minister BS Yediyurappa's statement that the state would go on appeal.

While Tamil Nadu's lawyers led by Supreme Court senior counsel K Parasaran are poring over the 1,000-page report of the tribunal, Karunanidhi is likely to convene an all-party meeting this week to discuss the state's course of action. “Tamil Nadu considers the award a just one, especially the monthly break-up that stipulates the release of 134 tmcft of water during the crucial Kuruvai crop season from June to September. But with Karnataka planning legal pressure, Tamil Nadu cannot afford to appear satisfied,” an official said.

Here is an argument TN would attempt to build to counter Karnataka’s plea: The tribunal award asks Karnataka to release only 192 tmcft to Tamil Nadu, against the 1991 interim award of 205 tmcft Tamil Nadu will be left with only 185 tmcft, after it releases seven tmcft to Pondicherry.
