Matrimonial portal fined for not e-mailing matches

NEW DELHI: An online matrimonial service has been directed by a consumer forum to pay Rs 15,000 as compensation for failing to provide suitable profiles to a consumer as per the contract.
 
A Delhi-based doctor had entered into a contract with Bharat Matrimonial Commercial Pvt Ltd, which runs an online matrimonial portal, for suitable matches for his son and daughter.
 
The portal refunded the registration fee in the case of the daughter, admitting its failure to provide the required services, but refused to part with the amount taken for the son, claiming his father had contacted families through their website.
 
However, the doctor refuted the portal's claim, contending that the profiles were not e-mailed as promised and he was left to search for a suitable match on his own.
 
Accepting the doctor's arguments, the North-West District Consumer Forum held that the portal was liable for "deficiency of service" and said that it was the "bounden duty" of the website to send the profiles of suitable matches to the other party.
 
"The non-providing of essential service by BMCPL to the complainant has not only caused mental agony and harassment to the complainant but to his family members, also which the BMCPL is liable to compensate," Forum President KS Khurana and member SC Jain said.
 
The forum further observed, "BMCPL, claiming to provide matrimonial services to render social services, are expected to be more sensitive and responsive to the needs of senior citizens who are looking for suitable matches for their grown up children."
 
BC Jain, an orthopedic surgeon had got registered with BMCPL in May 2005 in order to find suitable matches for his children under the paid category.
