Sushil Kothari moves court for bail

Businessman Sushil Kothari, arrested for allegedly ramming his car into two vehicles under the influence of alcohol killing one person and injuring another, has approached the sessions court seeking bail.

Kothari approached the sessions court today after a lower court on Saturday rejected his bail plea saying that the offence was serious and investigations were in progress.

Kothari, who is presently in judicial custody, has sought bail stating that his custody was not required further and that the accident was unfortunate.

Additional sessions judge NP Dhote directed the police to file their reply and adjourned the hearing on the bail plea till September 13.

Kothari, 30, who is into construction business, was arrested on September 1 after he allegedly rammed his car first into a scooter on Marine Drive killing the rider and injuring the pillion rider and subsequently hitting another four-wheeler at Malabar Hill in south Mumbai.

He had tested positive for alcohol intake.

"It was an unfortunate accident and the accused had no intention to kill or injure anyone. On the day of the accident, it was raining heavily and there were several bikers speeding around Kothari's vehicle," the bail plea states.

While he was booked for rash and negligent driving in the Malabar Hill case, he has been charged with culpable homicide in the case registered by the Marine Drive police.
