Central tribunal to rule on BA Dhayalan’s transfer on December 2

Dhayalan, who was transferred to reinstate Rachel Koshy as the chief executive officer (CEO) of the Pune Cantonment Board (PCB), has decided to go on leave till he gets the final order.

BA Dhayalan, who challenged his transfer as joint director of Defence Estates, Southern Command, before the Central Administrative Tribunal (CAT), Mumbai, will have to wait another two weeks.

The CAT on Monday heard his plea and decided to deliver its final order on December 2. Dhayalan, who was transferred to reinstate Rachel Koshy as the chief executive officer (CEO) of the Pune Cantonment Board (PCB), has decided to go on leave till he gets the final order.

“The tribunal heard both the sides and said that instead of an interim relief, the final order will be given on December 2. Koshy apprised the tribunal that she has already assumed charge as the PCB CEO and it has been ratified by the board president, Brigadier Rajbir Singh. My lawyers argued that I was the aggrieved party as I did not take up my new assignment. So I have decided to go on leave till the final order,” said Dhayalan.

In March, the DGDE transferred Koshy from Lucknow Cantonment Board as PCB CEO in place of DK Malik, who was promoted as the additional director general (ADG), Defence Estates.

Koshy, who had been transferred as joint director of defence estates on October 5 by the director general, Defence Estates (DGDE) was reinstated after allegations that it was done in a hasty manner by the than DGDE, Pal Saran Singh.

The appointment of Dhayalan, who was serving as the Lucknow Cantonment Board (LCB) CEO to the post of the PCB CEO had created a controversy as it was alleged that he faced a string of vigilance charges. Dhayalan moved the CAT after he was transferred from the PCB on November 11.

Bhavana Singh, Dhayalan’s successor at LCB also received a transfer order as joint director of defence estates, Central Command, the same day. She too moved the CAT, Lucknow, challenging her transfer and obtained a stay.
