The Bombay high court today rapped the Brihanmumbai Municipal Corporation (BMC) for failing to take timely action against unauthorised constructions and directed the civic body to start a survey of suburban Malad and submit a list of the number of illegal structures in that area.

A division bench of Justice PB Majmudar and Justice Amjad Sayed was hearing a petition filed by Balaji International School in Malad challenging an order passed by assistant municipal commissioner directing demolition of an electricity sub-station constructed in the school compound.

"Total lawlessness is prevailing in this city so far as unauthorised constructions are concerned. It is a sorry state of affairs," Justice Majmudar said while adjourning the matter till February 8.

"You (BMC) always realise at the last moment that certain construction is unauthorised and then you regularise it. The corporation should maintain transparency and act in accordance of law," the bench observed.

Pulling up the school management for going ahead with the construction work of the sub-station building despite having being served a stop work notice by BMC, the court said, "If school itself is violating the law, what education will you be providing to the students."

BMC counsel Anil Sakhare assured the court that the civic body would take necessary action against illegal constructions before the next date of hearing.
