Traffic constables can now impose fines for violations

The Maharashtra government informed the Bombay high court on Wednesday that they have reinstated the powers of traffic constables to impose fine on motorists for violating traffic rules and regulations.

Government pleader Jasbir Saluja informed a division of chief justice Mohit Shah and justice B P Colabawalla that, however, the constables have not been given the powers to impound licences.

The HC was hearing a public interest litigation filed by the Bombay Bar Association seeking proper implementation of traffic rules and regulations.

Last year, the government had issued a circular revoking powers of the constables to impose fines and impound licences to traffic rules violators.

The police department had then sent a proposal to the government last November seeking reinstatement of constables' powers. The government, on December 10, 2014 issued order reinstating constables' power to impose fine.

During the hearing, Saluja also informed that the RTO is still in the process of scanning and digitisation of registration details of 2.35 crore vehicles in the city. The RTO has not informed whether it has began digitisation process of vehicles which were registered before 2006.

The HC had earlier asked the RTO to complete digitisation process at the earliest so it will be easily accessible by traffic department in case of traffic rule violations by vehicle owners.

Also, the traffic department has asked all beat chowkies to ensure police presence at all times at important signals and junctions, said Saluja.

Last year, the traffic police department had also sent a proposal to the government seeking that they should be given 50 per cent of their revenue generated for modernisation.

The government has, however, not taken any decision on this proposal. Saluja said that the proposal is pending before the finance department.

In 2013, the HC had constituted a high-power committee which had given various suggestions to ease traffic woes in the city. Of the suggestions, the HC had directed that the two main ones be implemented expeditiously which concern sharing of data between the RTO and the traffic department and having prominent traffic signage including markings of zebra crossings.
