HC upholds life term for man who raped daughter

In one of those rare cases where a father is found guilty of raping his minor daughter, the Bombay high court on Wednesday confirmed life imprisonment of Satish Ramji Chaurasia.
The father of three children, including two sons, was convicted by a Vasai court in 2009 for raping the girl.

The high court, while upholding the conviction, took into account the victim’s and her mother’s testimony as crucial evidence, in addition to the medical evidence brought on record by the prosecution.

Chaurasia was a daily wage earner and his wife was doing a small business of making ‘bindi’. The girl was 12 years and was studying in class V at the time of incident.

In December 2005, the man first raped the girl at their house when there was no one and he threatened her of dire consequences if she told the incident to anyone. In February 2006, she was again raped by him in an under construction building in the vicinity. When she did not have her periods for months, her mother took her to three doctors.

The third doctor directed them to go to KEM Hospital. A sonography in August 2006 revealed that she was pregnant. This made her file a police complaint against her father, who was arrested.

During the trial, the prosecution examined eight witnesses including the victim, mother and doctors.

Pending the judgment in the trial court, the victim delivered a girl and a DNA test conducted on the child and the father-daughter proved the crime. The accused denied the charges and claimed he was being falsely implicated. The court sentenced him to life imprisonment.

Chaurasia challenged the verdict in the high court, which rejected his plea and confirmed his life sentence.
