Rajya Sabha Ethics Committee wants immediate expulsion of Vijay Mallya

The Upper House's ethics committee has also adopted a draft to that effect.

The Rajya Sabha Ethics Committee which met today to discuss businessman Vijay Mallya's membership in the Upper House has recommended that he be expelled immediately. 

It said that it wanted his expulsion with immediate effect and has also adopted a draft to that effect.

"The committee was of the firm view that taking into consideration the gravity of the misconduct, a sanction not less than termination of membership from the House is warranted under the circumstances," the Committee on Ethics said in its 10th report tabled in the Upper House by its Chairman Karan Singh today.

"Having considered the whole matter, including Dr Mallya's letter, the Committee on Ethics unanimously decided at its meeting on May 3 to recommend to the House that Dr Vijay Mallya be expelled with immediate effect," it said.

The Ethics Committee said that it hopes the message reaches the public that the "Parliament is committed to take such steps as are necessary against erring members."

On Tuesday, Mallya had submitted a resignation letter to the Rajya Sabha but it was turned down as it did not conform to the prescribed procedures and did not bear his original signature.

"Hamid Ansari, Chairman, Rajya Sabha does not accept the resignation of Vijay Mallya. Secretary General, Rajya Sabha writes to Sh. Mallya that his resignation letter does not conform to prescribed procedures & does not bear signature in original.

"As per Rule 213 of RS procedures, the resignation must be voluntary and genuine," Ansari's Officer on Special Duty to Gurdeep Singh Sappal said on Twitter quoting from the Secretary General's letter.

The Upper House will now take a call on the recommendation made by the ethics panel in the report "on the non-disclosure of liabilities such as the loans taken from different banks in his Assets and Liabilities Returns by Dr. Vijay Mallya, Member, Rajya Sabha."

Mallya had sent a scanned copy of his resignation from London, where he has been living since he left India on March 2. 

The Ethics' Committee first met to discuss Mallya's membership in the Rajya Sabha on April 25, where it had decided that the beleaguered businessman's membership should be cancelled. However, the Upper House decided to give him one week to respond.

Mallya, in his letter in response to the panel's offer to explain his position, "has raised some legal and constitutional issues which are not tenable, because the Supreme Court has clearly upheld the power of the Rajya Sabha to expel its members for gross misconduct unbecoming of a Member of the House," the report said.

The panel said "it is a matter of regret that Dr Mallya has thought it fit to impugn the (Supreme Court) judgement and impartiality of the Committee on Ethics as well as the entire House."
