With just 2 judges, cases pile up at co-op tribunal

While the Gujarat Co-operative Tribunal Bar Association has been fighting for the appointment of judges in the courts, information received through RTI revealed that there is huge backlog of cases pending. And thousands of crores of rupees also remain  to be recovered from defaulters.

The bar association had sought details of cases registered, disposed of and pending for each year from 1960 to 2008. As per the statistics, in 1994 there were only 424 pending cases before the tribunal when there were four judges to hear the cases.

However, in 2008 the numbers of pending cases reached 5,587 as there were only two judges. In the past three years, the number reached over 7,000.

Association president Hitendra Shah said, “Every year, on an average 500 new cases are filed in the tribunal and there are only two judges to hear the cases, so the number of pending cases has reached above 7,000.”

Moreover, there are 18 courts of board of nominees across the state. These courts deal with the disputes of associations and cooperative societies as well as the disputes of cooperative banks. However, at present only six such courts are functioning and in the rest, the posts are vacant. “Due to vacant posts in the courts of board of nominees, thousand of cases are not disposed of at the basic level and money worth thousands of crores remain to be recovered from the defaulters,” Shah added.

The association has been fighting for the appointment of judges in the courts of board of nominees as well members in the tribunals. “We have moved High Court on the issue. The state had also assured us about the same . However, so far there is no news. We are now again preparing to move the high Court against the state government,” Shah added.
