Sohrabuddin encounter: Brother gives notices to BJP leaders

Rubabuddin Sheikh has sent a notice to Gujarat BJP president and two other party leaders demanding an explanation as to why he should not file contempt of court petition against them for their remarks on CBI.

Rubabuddin, brother of Soharabuddin Sheikh who was killed in fake encounter in November 2005 by Gujarat police, has sent a notice to state BJP president and two other party leaders demanding an explanation on why he should not file contempt of court petition against them for their remarks on CBI.

In a notice given by his advocate Rajesh Mankad, Rubabuddin has said that the statements made by state BJP president R C Faldu, former president and MP Purshottam Rupala and state general secretary and MP Vijay Rupani against CBI amounts to contempt of Supreme Court.

Rubabuddin in the notice has asked the three leaders to give their explanation in seven days or else he would be filing contempt of court petition against them. 

The three leaders in a joint press conference organised here On May 2 had hit out at the Congress-led UPA government for "misusing the Central Bureau of Investigation (CBI) as instrument to tarnish the image of Gujarat government in Sohrabuddin fake encounter case."

They had made these remarks after arrest of IPS officer Abhay Chudasama and summoning of other six IPS officers by CBI, which was handed over the investigation of the case by Supreme Court, saying, "The leading investigating agency is becoming Congress Bureau of Injustice (CBI). The Centre wants to disturb the government by demoralising the police force with arrest of senior officials."

The three BJP leaders had further said, "at a time when the entire state was busy in celebrations of golden jubilee of Gujarat, CBI arrested the top cop of Ahmedabad and summoned other senior officials".

They had also said that Sohrabuddin was not innocent, as he was facing criminal cases in four states and was a hardened criminal having links with the underworld people.

Rubabuddin in his notice has said that the Supreme Court has given the investigation of encounter case and disappearance of his Sheikh's wife Kausar Bi, following a due legal process in which they had heard Gujarat government advocates also.

"It appears that the statements made by them were intended to affect the legal inquriy," Rubabuddin notice said. 

Sohrabuddin Sheikh was killed in joint operation by Gujarat and Rajasthan police in November 2005, while his wife was Kauser Bi was later allegedly murdered.
